Le parquet fédéral a reçu ce vendredi soir et ce samedi soir, par l’intermédiaire d’un avocat, deux plaintes émanant, toutes deux, de la Fondation Hind Rajab et de l’ONG Global Action Network. Ces plaintes sont relatives à des violations graves de droit international humanitaire commises dans la bande de Gaza dont se seraient rendus coupables deux membres de l’armée israélienne, en séjour en Belgique pour assister au festival Tomorrowland.
Après un premier examen de ces plaintes, le parquet fédéral a estimé qu’il pourrait disposer d’une compétence sur base du nouvel article 14/10 du Titre préliminaire du Code de procédure pénale, entré en vigueur le 28 avril 2024.
Cet article attribue une compétence extraterritoriale aux juridictions belges pour connaître des infractions commises hors de notre territoire et visées notamment par une règle de droit international conventionnelle, en l’espèce les Conventions de Genève du 12 août 1949 relatives aux crimes de guerre et la Convention des Nations unies contre la torture du 10 décembre 1984.
Eu égard à cette éventuelle compétence, le parquet fédéral a demandé à la police de localiser les deux personnes visées par la plainte et de procéder à leurs auditions. À l’issue de celles-ci, elles ont pu disposer.
À ce stade de l’enquête aucune information supplémentaire ne sera donnée.

Deze vrijdagavond en zaterdagavond heeft het federaal parket via een advocaat twee klachten ontvangen, beiden van de Hind Rajab Foundation en de NGO Global Action Network.
De klachten hebben betrekking op ernstige schendingen van het internationaal humanitair recht, begaan in de Gazastrook door twee leden van het Israëlische leger die in België waren om het Tomorrowland-festival bij te wonen.
Na een eerste onderzoek van deze klachten oordeelde het Federaal Parket dat het mogelijk bevoegd was op basis van het nieuwe artikel 14/10 van de Voorafgaande Titel van het Wetboek van Strafvordering, dat in werking trad op 28 april 2024.
Dit artikel verleent de Belgische rechtbanken extraterritoriale bevoegdheid voor feiten die buiten ons grondgebied zijn gepleegd en die onder een verdragsrechtelijke regel vallen, in dit geval de Verdragen van Genève van 12 augustus 1949 betreffende oorlogsmisdaden en het Verdrag van de Verenigde Naties tegen foltering van 10 december 1984.
Met het oog op deze mogelijke bevoegdheid heeft het federaal parket de politie gevraagd de twee in de klacht genoemde personen op te sporen en te verhoren. Na afloop van deze verhoren mochten zij beschikken.
In dit stadium van het onderzoek wordt geen verdere informatie verstrekt.

On Friday evening and Saturday evening, the Federal Public Prosecutor's Office received two complaints through a lawyer, both from the Hind Rajab Foundation and the NGO Global Action Network.
These complaints relate to serious violations of international humanitarian law committed in the Gaza Strip allegedly by two members of the Israeli army who were in Belgium to attend the Tomorrowland festival.
After an initial examination of these complaints, the Federal Public Prosecutor's Office considered that it might have jurisdiction pursuant to the new Article 14/10 of the Preliminary Title of the Code of Criminal Procedure, which entered into force on April 28, 2024.
This article confers extraterritorial jurisdiction on Belgian courts in respect of offences committed outside our territory and covered in particular by a conventional rule of international law, in this case the Geneva Conventions of 12 August 1949 relative to war crimes and the United Nations Convention against Torture of 10 December 1984.
In view of this possible jurisdiction, the Federal Public Prosecutor's Office asked the police to locate the two persons named in the complaint and to conduct the hearings. At the end of these hearings, they were free to leave.
