Le vendredi 18 et le samedi 19 juillet 2025, le parquet fédéral a reçu deux plaintes de la Fondation Hind Rajab à l’encontre de deux militaires israéliens présents sur le territoire belge pour assister au festival Tomorrowland à Boom.
Après analyse des plaintes, le parquet fédéral a décidé de transmettre les dossiers à la Cour pénale internationale. Cette décision a été prise dans l’intérêt d'une bonne administration de la justice et dans le respect des obligations internationales de la Belgique, conformément à l'article 14/10 du Titre préliminaire du Code de procédure pénale.
La Cour pénale internationale mène déjà actuellement une enquête sur de potentielles violations graves du droit international humanitaire commises sur les territoires palestiniens.
La transmission de ces dossiers à la Cour pénale internationale se fera par l’intermédiaire du SPF Justice, autorité centrale compétente pour transmettre à la Cour pénale internationale les demandes émanant des autorités judiciaires belges (loi du 29 mars 2004 concernant la coopération avec la Cour pénale internationale et les tribunaux pénaux internationaux).

Op vrijdag 18 en zaterdag 19 juli 2025 ontving het federaal parket twee klachten van de Hind Rajab Foundation tegen twee Israëlische militairen die zich op Belgisch grondgebied bevonden om het Tomorrowland Festival in Boom bij te wonen.
Na analyse van de klachten heeft het federaal parket beslist om de dossiers over te maken aan het Internationaal Strafhof. Die beslissing is genomen in het belang van een goede rechtsbedeling en met respect voor de internationale verplichtingen van België, zoals voorzien in artikel 14/10 van de voorafgaande titel van het Wetboek van Strafvordering.
Het Internationaal Strafhof voert momenteel al een onderzoek naar mogelijke ernstige schendingen van het humanitair recht in de Palestijnse gebieden.
De overzending van deze dossiers aan het Internationaal Strafhof zal gebeuren via de FOD Justitie, de centrale autoriteit die bevoegd is om de verzoeken van de Belgische gerechtelijke autoriteiten over te zenden aan het Internationaal Strafhof (wet van 29 maart 2004 betreffende de samenwerking met het Internationaal Strafhof en de internationale straftribunalen).

On Friday 18 and Saturday 19 July 2025, the Federal Public Prosecutor's Office received two complaints from the Hind Rajab Foundation against two Israeli soldiers who were on Belgian territory to attend the Tomorrowland festival in Boom.
After analysing the complaints, the Federal Public Prosecutor's Office decided to refer the cases to the International Criminal Court. This decision was taken in the interest of the proper administration of justice and in accordance with Belgium’s international obligations, as provided for in Article 14/10 of the Preliminary Title of the Code of Criminal Procedure.
The International Criminal Court is currently conducting an investigation into possible serious violations of humanitarian law in the Palestinian territories.
The referral of cases to the International Criminal Court will be carried out by the FPS Justice, the central authority competent to transmit requests from the Belgian judicial authorities to the International Criminal Court (Law of 29 March 2004 regarding cooperation with the International Criminal Court and the international criminal tribunals).
