Concerne :   Informations générales liées à l’audience de la chambre du conseil de ce mercredi 19 février dans le dossier « Attentats 22 mars 2016 »

 

Lors de l’audience du  19 février 2020, dite « audience de renvoi », la chambre du conseil évaluera la suite de la procédure. L’audience débutera à 9h00 .

Elle évaluera si les faits relèvent de la compétence d’assises et si les préventions à charge des inculpés sont suffisamment fondées.

Le juge d’instruction fera rapport de l’instruction menée, tandis que le parquet fédéral expliquera pour quels faits il souhaite poursuivre les inculpés.

Les avocats et toutes les parties qui le souhaitent auront la parole.

Le nombre d’inculpés effectivement présents en personne lors de cette audience n’est pas connu à ce stade.

Jusqu’à la veille de l’audience toutes les parties peuvent, si elles l’estiment nécessaire, demander des devoirs d’enquête complémentaires au juge d’instruction.

Si des devoirs complémentaires ont été demandés, la chambre du conseil devra reporter le traitement de l’affaire à une date ultérieure.

Il s’agit d’une audience à huis-clos, donc non accessible aux tiers et à la presse.

Indépendamment d’un éventuel appel, l’étape suivante dans la logique vers un procès aux assises, sera un nouvel examen du bien-fondé du réquisitoire du ministère public par la chambre des mises en accusation, notamment pour ceux pour lesquels le parquet postule le renvoi devant la cour d’assises.

A l’heure actuelle, on compte dans le dossier 617 parties civiles et 326 parties lésées.

Il est demandé aux membres de la presse de respecter le vœux de sérénité des victimes et, notamment, de ne pas diffuser d’images permettant d’identifier les victimes sans leur accord explicite. Certains locaux seront réservés à l’accueil des victimes. Les personnes extérieures au dossier n’y seront pas admises. Les interviews éventuelles pourront se faire à l’extérieur ou dans la salle des pas perdus.

Pour faciliter l’activité des journalistes, une salle du rez-de-chaussée leur sera réservée (dès 7h30 du matin) afin qu’ils puissent y travailler et éventuellement déposer leur matériel (attention cependant : il n’y aura pas de surveillance dans cette salle). Il s’agit de la salle 01.12. Si elle s’avérait trop petite, une seconde salle pourrait être mise à leur disposition (salle 01.10).

Un contrôle renforcé est prévu à l’entrée du palais de justice. Veuillez donc en tenir compte dans votre organisation. Le palais ouvre à 7h00

Betreft: algemene informatie over de zitting van de raadkamer van woensdag 19 februari in het dossier ‘Aanslagen 22 maart 2016’

 

Op de zitting van 19 februari 2020, ook de “verwijzingszitting” genoemd, zal de Raadkamer van de Franstalige rechtbank van eerste aanleg van Brussel oordelen over het vervolg van de procedure. De zitting begint om 9u.

De Raadkamer zal oordelen of de feiten tot de bevoegdheid van het hof van assisen behoren en of de tenlasteleggingen tegen de inverdenkinggestelden voldoende gegrond zijn.

De onderzoeksrechter zal verslag uitbrengen over het gevoerde onderzoek, het federaal parket zal toelichten voor welke feiten het de inverdenkinggestelden wenst te vervolgen.

De advocaten en alle partijen die dat wensen komen aan het woord.

Er is op dit moment niet geweten hoeveel inverdenkinggestelden aanwezig zullen zijn op de zitting.

Tot de avond vóór de zitting hebben alle partijen de mogelijkheid om, indien zij dit nodig achten, bijkomende onderzoeksdaden te vragen aan de onderzoeksrechter.

Indien bijkomende onderzoeksdaden gevraagd zijn, zal de raadkamer de zaak voor behandeling uitstellen naar een latere datum.   

Het is een zitting met gesloten deuren, dus niet toegankelijk voor derden, noch voor de pers.

Los van een eventueel beroep, is de volgende stap, indien er richting assisenproces wordt gegaan, een nieuw onderzoek naar de gegrondheid van de vordering van het openbaar ministerie door de kamer van inbeschuldigingstelling, met name voor diegenen waartegen het parket de verwijzing naar het Hof van Assisen vraagt.

Op dit moment telt het dossier 617 burgerlijke partijen en 327 benadeelde personen.

Aan de leden van de pers wordt gevraagd de wens tot sereniteit van de slachtoffers te respecteren en met name zonder expliciet akkoord, geen beelden te verspreiden waarop de slachtoffers herkenbaar zijn. Bepaalde lokalen zullen voorbehouden worden voor het onthaal van de slachtoffers. Personen extern aan het dossier zullen er geen toegang toe hebben. Eventuele interviews kunnen buiten afgenomen worden of in de wandelzaal.

Om de taak van de journalisten te vergemakkelijken, wordt een zaal op het gelijkvloers voor hen gereserveerd (van 7u30), opdat zij er kunnen werken en er eventueel hun materiaal kunnen neerzetten (opgelet echter : er zal geen bewaking zijn in deze zaal). Het betreft de zaal 01.12. Indien deze te klein zou blijken, kan een 2de zaal ter beschikking gesteld worden (zaal 01.10).

Een opgedreven controle is voorzien aan de ingang van het justitiepaleis. Gelieve hier rekening mee te houden bij uw organisatie. Het paleis opent om 7u.

Concerns:      General information relating to the hearing before the Pre-trial Chamber this Wednesday 19 February in the “Attacks of 22 March 2016” file

 

At the hearing on 19 February 2020, known as the “referral hearing”, the Pre-trial Chamber will assess the further course of the proceedings. The hearing will begin at 9:00 a.m.

It will assess whether the facts fall within the jurisdiction of the Assize Court and whether the charges against the accused are sufficiently well-founded.

The investigating magistrate will report on the investigation carried out, while the Federal Prosecutor’s Office will explain the facts for which it wishes to prosecute the accused.

Lawyers and all parties who wish to speak will have the opportunity to do so.

The number of accused actually present in person at this hearing is not known at this stage.

Until the eve of the hearing all parties may, if they deem it necessary, request additional investigative duties from the investigating magistrate.

If additional duties have been requested, the Pre-trial Chamber will have to postpone the handling of the case to a later date.

This is an in camera hearing and therefore not accessible to third parties and the press.

Irrespective of a possible appeal, the next logical step towards an Assize trial will be a further review of the validity of the indictment of the Public Prosecutor’s Office by the Indictments Chamber, in particular for those for whom the prosecutor’s office demands a referral to the Court of Assize.

There are currently 617 civil parties and 326 injured parties in the file.

Members of the press are asked to respect the victims’ wishes for serenity and, in particular, not to disseminate images that could identify the victims without their explicit agreement. Some premises will be reserved for the reception of the victims. Persons who are not part of the file will not be admitted. Interviews may be conducted outside or in the public lobby.

To facilitate the activity of journalists, a room on the ground floor will be reserved for them (from 7:30 a.m.) so that they can work there and possibly deposit their equipment (attention however: there will be no surveillance in this room). This is room 01.12. If it proves too small, a second room could be made available to them (room 01.10).

A reinforced control is planned at the entrance of the Palace of Justice. Please take this into account in your planning. The Palace opens at 7:00 a.m.
