Betreft: criminele organisatie, witwas, private corruptie

In het kader van een onderzoek van het federaal parket, gevoerd door een onderzoeksrechter te Limburg, werden op 10 oktober 2018 over het hele land 44 huiszoekingen verricht. Deze huiszoekingen werden uitgevoerd door de Federale Gerechtelijke Politie Limburg, met steun van de Federale Gerechtelijke Politiediensten van Antwerpen, Leuven, Waals-Brabant, Brussel, Halle-Vilvoorde, Oost-Vlaanderen, West-Vlaanderen, Bergen en Luik. Ook de Wegpolitie en het Interventiekorps van de geïntegreerde politie verleenden hun steun.

De huiszoekingen werden onder meer uitgevoerd op de zetel van 9 voetbalclubs RSC Anderlecht, Club Brugge, KRC Genk, KV Kortrijk, KV Mechelen, KV Oostende, Sporting Lokeren, AA Gent en Standard Luik. Hierbij werden verschillende documenten en dossiers in beslag genomen, evenals 3 luxehorloges.

Tevens werden huiszoekingen verricht bij zes bestuursleden van voetbalclubs, vier spelersmakelaars, twee scheidsrechters, één voormalig advocaat, een boekhoudkantoor, twee juweliers, twee journalisten, een trainer en enkele mogelijke medeplichtigen.

Hierbij werden onder meer lege verpakkingen van luxehorloges ter waarde van 8.000.000 euro, juwelen, luxehorloges, en cash geld in beslag genomen

Tegelijk werden op verzoek van de onderzoeksrechter ook 14 huiszoekingen verricht in het buitenland, met name in Frankrijk, Luxemburg, Cyprus, Montenegro, Servië en Macedonië. Deze simultane tussenkomsten werden gecoördineerd via Eurojust. De huiszoekingen vonden voornamelijk plaats op de zetels en bij de zaakvoerders van buitenlandse rechtspersonen die gebruikt zouden zijn bij het opzetten van de verdachte financiële verrichtingen. Hierbij werden documenten en tegoeden op bankrekeningen en in kluizen in beslag genomen, voor een totaal bedrag van 3.600.000 euro

In totaal namen aan deze actie in België 184 politiemensen en in het buitenland 36 politiemensen deel.

In België werden gisteren 28 personen onderschept voor verhoor. 22 onder hen zullen worden voorgeleid bij de onderzoeksrechter.

Deze ochtend werd 1 persoon bijkomend van zijn vrijheid beroofd voor verhoor.

In het buitenland werden 4 personen onderschept. De onderzoeksrechter vaardigde een Europees aanhoudingsbevel uit tegen U.J. en N.P.

Het federaal onderzoek is eind 2017 opgestart naar aanleiding van een verslag van de Cel Sportfraude van de federale politie, met aanwijzingen van verdachte financiële verrichtingen in het Profvoetbal 1A, via onder meer tientallen bankrekeningen gehouden in een bankkantoor te Genk. Twee spelersmakelaars zouden – onafhankelijk van mekaar – deze verrichtingen opgezet hebben. Hierdoor werden commissies bij spelerstransfers, verloningen van spelers en trainers, en andere betalingen verborgen voor de Belgische overheid en voor andere betrokkenen bij de transacties.

Tijdens het onderzoek doken aanwijzingen op van mogelijke beïnvloeding van minstens twee wedstrijden in de degradatiestrijd op het einde van het competitieseizoen 2017-2018. Het federaal parket vorderde hierop de onderzoeksrechter om zijn onderzoek uit te breiden met deze feiten.

Het gerechtelijk onderzoek betreft activiteiten in het kader van een criminele organisatie, witwassen van geld en private corruptie.

Een eerste luik van het gerechtelijk onderzoek heeft betrekking op de activiteiten van de Belgische spelersmakelaar D.V.

Het onderzoek bevat aanwijzingen dat D.V. meermaals constructies zou opgezet hebben, in samenspraak met enkele voetbalclubs waaronder KV Mechelen, KRC Genk, Sporting Lokeren, Club Brugge en Standard Luik, om zichzelf verdoken commissielonen voor zijn activiteiten als makelaar uit te betalen en om spelers voor wie hij optreedt, verdoken verloningen en vergoedingen te bezorgen. D.V. zou hierbij gebruik maken van overeenkomsten en facturen met algemene vermeldingen als ‘scouting’, ‘consulting’, ‘commission fees’, ‘provisions’ of ‘extra costs’. Deze gelden passeren via rechtspersonen die geleid worden door medeplichtigen waaronder familieleden van D.V., maar die in werkelijkheid onder zijn controle lijken te staan. Deze rechtspersonen bevinden zich in Cyprus, Montenegro en Servië.

Een tweede luik van het gerechtelijk onderzoek heeft betrekking op de activiteiten van de Belgische spelersmakelaar A.B.

Het onderzoek bevat aanwijzingen dat A.B. de transfer van verschillende spelers gemanipuleerd zou hebben met het oogmerk de eigen makelaarsvergoedingen te maximaliseren, waarbij de belangen van de partijen waarvoor hij optreedt, benadeeld werden. Daarbij zouden constructies opgezet zijn om deze manipulaties verborgen te houden voor de betrokken clubs en spelers. Hierbij zou hij gebruik maken van de diensten van medeplichtige spelersmakelaars en van rechtspersonen in onder meer Frankrijk, Engeland en Luxemburg. Een groot deel van de aldus gegenereerde geldstromen lijkt te passeren via de derdenrekening van voormalig advocaat L.D. uit Brussel, waarna een deel hiervan cash wordt afgehaald. L.D. stond tevens in voor de opmaak van de betreffende spelerscontracten en andere documenten.

Het onderzoek bevat eveneens aanwijzingen dat A.B. luxehorloges aankoopt om als relatiegeschenk te gebruiken bij zijn makelaarsactiviteiten. Deze horloges lijken meermaals frauduleus te zijn gededouaneerd om de hierop betaalde BTW te kunnen recupereren.

Een derde luik van het gerechtelijk onderzoek heeft betrekking op aanwijzingen van private omkoping in het kader van de redding van KV Mechelen van een dreigende degradatie naar de klasse 1B.

Het onderzoek spitst zich onder meer toe op de wedstrijd Antwerp-Eupen van de voorlaatste speeldag (3 maart 2018) en de wedstrijd KV Mechelen-Waasland Beveren van de laatste speeldag van de competitie (11 maart 2018). Het onderzoek bevat aanwijzingen dat spelersmakelaar D.V., in samenspraak met vier bestuursleden van KV Mechelen, rechtstreeks of via bevriende contacten de uitslag zou beïnvloed hebben van deze twee wedstrijden. Hierbij lijken onder meer afspraken gemaakt te zijn met scheidsrechter B.V. en diverse bestuursleden van Waasland Beveren.  Om scheidsrechter B.V. ter wille te zijn, lijken contacten gelegd met twee sportjournalisten om de quotering van scheidsrechterprestaties in de krant ten voordele van B.V te beïnvloeden.

Daarnaast zijn er ook aanwijzingen van ongeoorloofde contacten tussen D.V. en scheidsrechter S.D. in ruil waarvoor bepaalde voordelen zouden gegeven zijn. Het onderzoek betreft onder meer de beïnvloeding van de mogelijke schorsing van een uitgesloten voetbalspeler.

De onderzoeksrechter stelde voor deze feiten 4 personen in verdenking van criminele organisatie en actieve en passieve private omkoping. Een 5de persoon werd bijkomend van witwassen van gelden in verdenking gesteld.

Het betreffen

-         T.S.              Hij werd onder aanhoudingsmandaat geplaatst

-         D.H.   -         Hij werd vrijgelaten onder voorwaarden

-         O.S.   -         Hij werd vrijgelaten onder voorwaarden

-         S.D.              Hij werd vrijgelaten onder voorwaarden

-         D.V.    -         Hij werd in vrijheid gesteld

18 personen worden later op de dag nog voorgeleid bij de onderzoeksrechter.

Het onderzoek gaat verder. In het belang hiervan kunnen voorlopig geen verdere gegevens verstrekt worden.

Concerne : organisation criminelle, blanchiment et corruption privée

 

Dans le cadre d'une enquête du parquet fédéral, menée par le juge d'instruction du Limbourg, 44 perquisitions ont été effectuées dans tout le pays ce 10 octobre 2018. Ces perquisitions ont été effectuées par la Police Judiciaire Fédérale du Limbourg, avec le soutien des polices judiciaires fédérales d'Anvers, de Louvain, du Brabant Wallon, de Bruxelles, de Halle-Vilvorde, de Flandre orientale, de Flandre occidentale, de Mons et de Liège. L’opération a également été soutenue par la Police de la route et par le Corps d'intervention de la police intégrée.

Les perquisitions ont été effectuées au siège de 9 clubs de football :  le  RSC Anderlecht, FC Bruges, KRC Genk, FC Courtrai, FC Malines, FC Ostende, Sporting Lokeren, La Gantoise (KAA Gent) et Standard de Liège. Plusieurs documents et dossiers y ont été saisis, ainsi que trois montres de luxe.

Des perquisitions ont également été effectuées chez six membres du conseil d'administration de clubs de football, quatre agents de joueurs, deux arbitres, un ancien avocat, un bureau comptable, deux journalistes, deux bijoutiers, un entraineur et quelques complices potentiels. Divers objets ont été saisis. Notamment des montres de luxes, des bijoux et de l’argent liquide. Des boites vides ayant contenu des montres de luxe d’une valeur totale de  8 millions d’Euros ont également été trouvées.

Parallèlement, à la demande du juge d'instruction, 14 perquisitions ont également été effectuées à l'étranger, notamment en France, au Luxembourg, à Chypre, au Monténégro, en Serbie et en Macédoine. Ces interventions simultanées ont été coordonnées par Eurojust.

Ces dernières perquisitions ont été effectuées principalement dans les bureaux et chez des dirigeants de personnes morales étrangères qui auraient servi à mettre en place les opérations financières suspectes. Des documents et des avoirs dans des comptes bancaires et des coffres-forts ont été saisis, pour un total de 3,6 millions d’Euro.

Au total, 184 policiers ont participé à cette action en Belgique et 36 policiers à l'étranger.

En Belgique, hier, 28 personnes ont été interceptées pour audition. 22 seront présentées au juge d’instruction. Ce jeudi matin une personne supplémentaire a été privée de liberté.

A l’étranger, 4 personnes ont été interceptées. Le juge d’instruction a décerné un mandat d’arrêt européen pour d’eux d’entre-elles : U. J et N.P.

L'enquête fédérale a été ouverte fin 2017 à la suite d'un rapport de l'Unité des fraudes sportives de la police fédérale.

Le rapport faisait état de transactions financières suspectes dans la division 1A, via, entre autres, des dizaines de comptes bancaires détenus dans une agence de Genk. Deux agents de joueurs,  indépendamment l’un de l’autre, auraient mis en place ces transactions. Elles auraient dissimulé, aux autorités belges et aux autres parties impliquées, des commissions occultes. Ces commissions  porteraient sur les transferts de joueurs, sur les salaires de joueurs et d’entraîneurs, ainsi que sur d'autres paiements.

Au cours de l’enquête, il est apparu qu'au moins deux matchs de relégation pourraient avoir subi une influence à la fin de la saison de championnat 2017-2018. Le parquet fédéral a alors demandé au juge d'instruction d'étendre son enquête à ces faits.

L'instruction couvre des activités qui auraient été menées dans le cadre d'une organisation criminelle, du  blanchiment d'argent et de la corruption privée.

Une première partie de l'instruction judiciaire concerne les activités de l'agent de joueurs belge D.V. L'enquête contient des indications selon lesquelles D.V. aurait mis en place des constructions financières,  à plusieurs reprises, en concertation avec un certain nombre de clubs de football dont le FC Malines, KRC Genk, Sporting Lokeren, Club de Bruges et Standard de Liège. Ces constructions auraient été destinées à payer des commissions cachées pour ses activités de courtier et à fournir à certains joueurs une rémunération et des avantages dissimulés. D.V. aurait utilisé des contrats et des factures avec des mentions générales telles que " scouting ", " consulting ", " commissions ", " provisions " ou " frais supplémentaires ". Ces fonds transiteraient par des entités juridiques à Chypre, au Monténégro et en Serbie. Ces entités seraient dirigées par des complices, dont des membres de la famille de D.V., mais, en réalité, elles semblent être sous son contrôle. 

Un deuxième volet de l'instruction judiciaire porte sur les activités de l'agent de joueurs belge A.B. L'enquête contient des indications selon lesquelles A.B. a manipulé le transfert de plusieurs joueurs dans le but de maximiser ses propres frais de courtage, portant ainsi préjudice aux intérêts des parties pour lesquelles il agit. Des constructions financières auraient été mises en place pour cacher ces manipulations aux clubs et aux joueurs concernés. Pour ce faire, A.B. aurait eu recours aux services d'agents de joueurs complices et de personnes morales en France, en Angleterre et au Luxembourg, entre autres.

 Une grande partie des flux d'argent ainsi générés semblait transiter par le compte tiers de l'ancien avocat L.D. de Bruxelles, après quoi une partie de cet argent aurait été collectée en espèces. L.D. était également responsable de la rédaction des contrats de joueurs et d’autres documents pertinents.

L'enquête contient également des indications selon lesquelles A.B. aurait acheté des montres de luxe pour les utiliser comme cadeaux d'affaires dans le cadre de ses activités de courtage. Ces montres semblent avoir été frauduleusement dédouanées à plusieurs reprises afin de récupérer le montant de la TVA.

Une troisième partie de l'instruction judiciaire concerne des indices de corruption privée dans le cadre du sauvetage du FC Malines qui luttait alors contre sa relégation en division 1B.

La recherche se concentre entre autres sur le match Anvers-Eupen de l'avant-dernière journée de championnat (3 mars 2018) et le match FC Malines-Waasland Beveren de la dernière journée de la compétition (11 mars 2018). L'enquête révèle que l'agent de joueurs D.V., en concertation avec quatre membres du conseil d'administration du FC Malines, pourrait avoir influencé les résultats de ces deux matchs directement ou par des contacts amicaux. Il semble que des accords aient été conclus, entre autres, avec l'arbitre B.V. et divers membres du conseil d'administration de Waasland Beveren.  Afin  d’aider l’ arbitre B.V., des contacts auraient été pris avec deux journalistes sportifs dans le but  d’ influencer le classement des performances des arbitres de leur journal en faveur de B.V.

En outre, il existe également des indications de contacts non autorisés entre l'agent de joueurs D.V. et le juge-arbitre S.D. en échange desquels certains avantages auraient été accordés. L'enquête porte, entre autres, sur une éventuelle influence suspecte dans  la décision d’absence de suspension d'un joueur de football exclu.

Pour ces faits, le juge d’instruction a inculpé 4 personnes pour participation à une organisation criminelle et corruption privée active et passive : S.D. (libéré sous conditions), D.H. (libéré sous conditions), O.S. (libéré sous conditions), D.V. (remis en liberté). Une 5e personne (T.S.) a été placée sous mandat d’arrêt pour blanchiment d’argent,  pour participation à une organisation criminelle et corruption privée active et passive.

18 personnes doivent encore être présentées au juge d’instruction dans le courant de la journée.

L’enquête se poursuit. Dans ce contexte, aucune autre information ne peut être fournie pour l'instant.

Concerns: organised crime, money laundering, private corruption

 

Within the framework of an investigation conducted by the Investigating Judge of Limburg on behalf of the Belgian Federal Public Prosecutor’s Office, 44 house searches across Belgium have been carried out on the 10th of October 2018. These searches were carried out by the Belgian Federal Judicial Police of Limburg, supported by the Federal Judicial Police services of Antwerp, Leuven, Walloon Brabant, Brussels, Halle-Vilvoorde, East-Flanders, West-Flanders, Mons and Liège. Also the Belgian Road police and the Intervention Force of the integrated police gave assistance.

The house searches were carried out at the offices of the football clubs RSC Anderlecht, Club Bruges, KRC Genk, KV Kortrijk, KV Mechelen, KV Oostende, Sporting Lokeren, AA Ghent and Standard Liège. Various documents and files have been seized, as well as 3 luxury watches.

Further house searches have been carried out at the residence of six members of the board of several football clubs, four brokers in the football players market, two referees, one former lawyer, an accountancy bureau, two jewelers, two journalists, a trainer and some possible accomplices.

Amongst other things empty deluxe watches’ boxes valued at 8.000.000 euros, jewels, luxury watches, and cash have been seized

At the request of the Investigating Judge, a further 14 house searches have simultaneously been carried out in France, Luxemburg, Cyprus, Montenegro, Serbia and Macedonia. The simultaneous interventions abroad have been coordinated by Eurojust. These house searches chiefly took place at the offices and in the residence of directors of foreign moral persons that may have been used at setting up the suspect financial schemes. Documents and assets on bank accounts and in safes have been seized, for a total amount of 3.600.000 euros.

In all, 184 Belgian policemen and women participated in the operation, 36 foreign ones were mobilized abroad.

In Belgium 28 persons were yesterday deprived of their liberty for questioning. 22 of them will be heard by the investigating judge.

This morning an additional person has been deprived of his liberty for questioning.

Abroad 4 persons have been intercepted. The investigating judge issued a European arrest warrant against U.J. and N.P.

The federal investigation was started up in late 2017 as a result of a report drawn up by the Sports Fraud Cell with detailed indications of suspect financial operations in the world of Professional Football 1A through tens of bank accounts opened in a bank office in the city of Genk. Two brokers in the players market may have schemed this, independently of each other. The scheme allows to hide commissions at players transfers, remunerations of players and trainers and other payments for the Belgian authorities and other people involved in the transactions.

During the investigation further indications surfaced of possible influencing of at least two matches in the battle to avoid relegation to a lower division at the end of the competition season 2017-2018.  The Federal Public Prosecutor’s Office as a consequence requested the Investigating Judge to extend his investigation to these new facts.

The judicial investigation concerns activities within the framework of a criminal organization, money laundering and private corruption.

A first component of the judicial investigation relates to the activities of the Belgian broker in the players market D.V.

D.V. is suspected of having set up several schemes in connivance with a few football clubs, among which KV Mechelen, KRC Genk, Sporting Lokeren, Club Bruges and Standard Liège in order to pay hidden commissions to himself for his activities as a broker and to provide the players for who he mediates with hidden remunerations and compensations. D.V. may to this effect have used contracts and invoices with general heads such as ‘scouting’, ‘consulting’, ‘commission fees’, ‘provisions’ or ‘extra costs’. These funds transit through moral persons directed by accomplices, family members of D.V., who in reality are under his control.  These moral persons have their offices in Cyprus, Montenegro and Serbia.

A second component of the judicial investigation relates to the activities of the Belgian broker in the players market A.B.

A.B. is suspected of having manipulated the transfer of various players in order to maximize his own broker’s fees at the expense of the interests of the parties he asserts. Schemes would have been set up to this effect in order to hide these manipulations for the football clubs and players concerned. He may have used the services of fellow brokers and of moral persons in France, England and Luxembourg, among others. To a large extent, the flows of money generated in that way seem to transit through the third party bank account of former lawyer L.D. of Brussels, after which a part of the money is collected in cash. L.D. was also entrusted with drawing up the player contracts and other documents.

The investigation also contains indications as to A.B. purchasing luxury watches to be used as promotional presents in his broker’s activities. These watches appear frequently to have been illegally customs cleared in order to recover the VAT paid for them.

A third component of the judicial investigation relates to indications of private corruption within the framework of rescuing football club KV Mechelen from a risk to being relegated to division 1B.

The investigation among other things focuses on the Antwerp-Eupen match of the penultimate competition day (3 March 2018) and on the KV Mechelen-Waasland Beveren match of the ultimate competition day of the season (11 March 2018). The investigation contains indications as to broker in the players market D.V., in connivance with four members of the board of football club KV Mechelen having directly or through friendly contacts influenced the final score of these two matches. It seems arrangements have been made to that effect with referee B.V. and various directors of the board of football club Waasland Beveren. In order to do a favor to B.V., it seems two sports journalists have been contacted in order to influence the ranking of referee performances in the press to the benefit of B.V.

There are furthermore indications of illicit contracts passed between D.V. and referee S.D. in exchange of which certain benefits would have been granted. The investigation concerns also the influencing of the suspension proceedings of an excluded football player.

The investigating judge charged 4 persons with criminal organization and active and passive corruption. A 5th person has been additionally charged with money laundering

18 persons will be heard later today by the investigating judge.
